“Win a REAL Authentic 1964 1/2_ Ford Mustang” Sweepstakes—Official Rules

No Purchase Necessary. A purchase will not increase your chances of winning the prize.
  1. The Sweepstakes Period is from January 1, 2007 ("Sweepstakes-Start") to April 17, 2008 ("Sweepstakes-End").
  2. Eligibility: This Sweepstakes is open only to legal residents of the 50 United States and DC who are the age of majority in their State of residence or older at Sweepstakes-Start. Void in Puerto Rico and other US territories. Employees, officers, directors, agents, representatives and their immediate families (spouse, parents, children, siblings, and each of their spouses regardless where they live) or members of household of Lipenwald, Inc. and THE MARKETING AGENCY, LLC, their respective parent companies, subsidiaries, advertising, design, printing and publicity agencies and anyone connected with the production or distribution of this Sweepstakes are not eligible to enter or be awarded the prize.
  3. How to Enter: There are two ways to enter: 1) Go to www.motormint.com and register by supplying your Name, Full Address, email address and Daytime Phone Number. Limit one online entry per person or email address. 2) You may also enter by sending a postage paid, 3_"x5_" postcard with your hand-printed Name, Full Address and Daytime Phone Number to “Win a REAL Authentic 1964 1/2_ Ford Mustang” Sweepstakes, c/o 22 South Smith Street, Norwalk, CT 06850. Limit one entry per person or address per day. Mailed entries that are larger than 4”x6”, or inserted in envelopes will be discarded.
  4. Winner Selection: Sweepstakes may be presented in different creative presentations. Winners will be chosen in random drawings approximately twenty (20) days after Sweepstakes-End from all eligible entries awarded and received during the Sweepstakes Period. Potential winners will be notified within twenty (20) days after the selection is made via USPS mail or another method of delivery at Sponsor’s discretion. Sweepstakes registered by The Marketing Agency, LLC, 233 Needham Street, Suite 300, Newton MA 02464 and may be presented in different creative presentations.
  5. Quantity, Prize, Approximate Retail Value (ARV) and Odds: (1) Grand Prize: A REAL authentic 1964 1/2_ Ford Mustang or a check for $20,000. The vehicle prize will be awarded “as is” and the vehicle will be in “good” condition. Sponsor does not represent that the vehicle will be in “excellent” or “mint” condition, however the vehicle will be in “drivable” condition. ARV: $20,000. (1000) First Prize: A National Motor Museum Mint die cast car. ARV: $20. (6000) Second Prize: A gift certificate valued at $10 to be used to purchase, or as partial payment towards, any National Motor Museum Mint die cast car. ARV: $10. Odds of winning any Prize: Sweepstakes may be presented in different creative presentations. Dependent on number of eligible entries awarded and received during the Sweepstakes Period from all creative presentations.
  6. General: Sweepstakes administration and winner selection and verification will be supervised by THE MARKETING AGENCY, LLC, an independent judging organization whose decisions are final and legally binding. No participant or winner shall have the right to contest any decision by Sponsor or the independent judging organization concerning any aspect of the Sweepstakes or the interpretation of the Official Rules or the determination as to the qualification of entries. By participating in this Sweepstakes, you agree to be bound by these Official Rules. Sponsor is not responsible for those who cannot access the Internet or cannot click-through for any period of time regardless of technical, hardware, software, telephone, Internet, virus contamination or network problems, and for delay, failure or malfunction for any reason. Sponsor reserves the right to modify/cancel/terminate the Sweepstakes if in Sponsor’s sole determination it believes that the integrity of the Sweepstakes has been, or could be, compromised or that the Sweepstakes is not capable of running as planned or fairly including where there is infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, Force Majeure, to comply with any applicable law or any other causes that might compromise the fairness of the Sweepstakes. Prizes will not be awarded. Sponsor assumes no liability for damage caused to entrant's or any other person's/entity's computer hardware, software or communications network for any reason. Sponsor reserves the right to disqualify any mail-in entry from the Sweepstakes if in Sponsor’s sole judgment entrant has not complied with these Official Rules. Without limitation, all of an entrant’s entries will be disqualified, at the sole discretion of Sponsor, if entrant attempts (i) to enter the Sweepstakes through any means other than as described in these Official Rules; or (ii) provides information that is inaccurate or fraudulent. Only the prizes listed and the value listed in the Official Rules shall be awarded. The Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release within seven (7) days of date on notification or it will be concluded definitively that the prize has been declined and, without further notice, an alternative winner may be selected in random drawings. If Grand Prize winner is less than 21 years of age the Affidavit of Eligibility, Liability and Publicity Release will have to be signed by a parent or legal guardian. Grand Prize winner is responsible for having the vehicle evaluated by a professional mechanic for mechanical worthiness prior to driving it, all licenses, insurance, taxes or other “fees” or “cost” associated with the use of this vehicle. By entering this Sweepstakes, you understand and explicitly agree that driving any vehicle comes with the risk of injury, death and property damage and that driving a vintage vehicle increases that risk. By entering the Sweepstakes and accepting the Grand Prize you explicitly release and hold harmless Lipenwald, Inc. and THE MARKETING AGENCY, LLC, their respective affiliates, parent companies, agents, subsidiaries, successors and their respective promotion, advertising, design, web design, web hosting and production agencies and print production agencies and all their respective shareholders, directors, officers and employees, one and all, from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever in law or equity, including all “costs”, which you now have or may acquire, by reason of any personal injury, death, loss of or damage to property, or any reason, occurring during or arising out of your participation in the Sweepstakes and the acceptance and use or misuse of a prize. Prizewinner waives the right to 1) assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize, and 2) claim any liability (including attorney's fees and costs) which might arise from redeeming, seeking to redeem or traveling to/from redeem said prize. The right to receive the prize is non-assignable and non-transferable and no prize substitution, transfer or exchange will be allowed except by Sponsor who has the right to substitute a prize of equal or greater value. A prize or prize notification that is returned as undeliverable will disqualify the winner and an alternative winner may be selected in random drawings. Sweepstakes void where prohibited, licensed, restricted or taxed.
  7. All federal, state and local laws and regulations apply. If any provision of this Sweepstakes shall be deemed to violate any federal, state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect.
  8. This offer, or a summary of this offer, may not be reproduced, reprinted or published elsewhere in any format without the written permission of the sponsor.
  9. All taxes are winners’ responsibility and a 2008 form #1099 will be issued to Grand Prize winner in the amount of $20,000.
  10. Entering the Sweepstakes constitutes permission to use the winner's name, city, state, voice and likeness and any and all identifying characteristics including, but not limited to, the taking of photographs and/or videos by Sponsor's photographer/videographer for publicity purposes, without further consent or compensation, unless prohibited by law and winner agrees to execute any and all documents requested by Sponsor to convey such rights to own all the results thereof. Nothing contained herein shall be deemed to obligate Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind.
  11. Lipenwald, Inc. and THE MARKETING AGENCY, LLC and all production agencies are not be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.
  12. All entries submitted become the property of Sponsor and none will be acknowledged or returned. Sponsor not responsible for lost or late entries or payments. Duplicate, illegible, mutilated, postage due or incomplete mail-in payments/entries, copies and other mechanical reproductions and mail-in entries from groups and syndicates are not permitted. Proof of mailing is not proof of receipt. Sponsor and The Marketing Agency, LLC collect personal information from you when you enter the Sweepstakes. The information collected is subject to Sponsor's Privacy Policy found on the Sponsor’s collection of websites devoted to die cast vehicles and/or at http://www.motormint.com/index.asp?PageAction=Custom&ID=49 and The Marketing Agency’s Privacy Policy found at http://themarketingagency.com/html/sweepstakes.html.
  13. Entrant agrees that any and all disputes, claims, action and causes of action arising out of or connected with this Sweepstakes or the prize awarded and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively in a court of competent jurisdiction sitting in Fairfield County Connecticut. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes and never shall include consequential, incidental or punitive damages, and in no event attorneys' fees. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
  14. For the name of the Grand Prize winner — available on or about May 30, 2008, send a self addressed, stamped, # 10, business envelope to Winners — “Win a REAL Authentic 1964 1/2_ Ford Mustang” Sweepstakes, c/o The Marketing Agency, 233 Needham Street, Suite 300, Newton MA 02464 to be received by April 30, 2007. You cannot enter the Sweepstakes using this address. Entries mailed to this address will be discarded.
  15. This Sweepstakes is sponsored by Lipenwald, Inc., 22 South Smith Street, Norwalk, CT 06855 (“Sponsor”). This Sweepstakes is administered by The Marketing Agency, LLC, 233 Needham Street, Suite 300, Newton, MA 02464 (“Administrator”).
